In a significant development, the wife of Pravesh Shukla, who was arrested for urinating on a tribal man in Sidhi district of Madhya Pradesh, has moved the Madhya Pradesh High Court. She is challenging the invocation of the National Security Act (NSA) to detain her husband, claiming that his detention is politically motivated.

The incident, captured in a viral video, showed Shukla urinating on Dashmat Rawat, a tribal man. Following the incident, Shukla was arrested under the relevant sections of the Indian Penal Code (IPC) and the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act. Additionally, he was slapped with the NSA charge and is currently in custody.

In the habeas corpus plea filed by advocate Aniruddha Kumar Mishra on behalf of Kanchan Shukla, the petitioner alleges that her husband's detention is influenced by political pressure. She further claims that Chief Minister Shivraj Singh Chauhan "guided" the Collector to invoke the stringent provisions of the NSA against Pravesh.

Advocate Mishra confirmed the plea and stated, "Our main prayer is to release him as no offense under section 3(2) of the NSA is made out. The Collector invoked NSA under political pressure, and he was guided by the Chief Minister."

The plea highlights that the detention order fails to specify the duration of Pravesh's detention and lacks specific reasons for the same. It argues that indefinite detention is unjustifiable and imposes undue hardship on Pravesh's family.

Furthermore, the plea contends that the detention order denies Pravesh the opportunity to make a representation against his detention, violating his fundamental rights. It specifically cites Article 22(1) of the Constitution of India, which grants a detenu the right to present a representation before the detaining authority.

The matter is expected to be presented before a bench comprising Chief Justice Ravi Malimath and Justice Vishal Mishra.
