Uttarakhand Bar Council Assures High Court: Complaints Against Advocates to Be Filed at Reduced Fee of ₹1,750 Instead of ₹5,500
The Bar Council of Uttarakhand has provided assurance to the Uttarakhand High Court that the fee for filing complaints against advocates for professional misconduct will not exceed ₹1,750. This comes as the State Bar Council awaits the approval of the Bar Council of India (BCI) regarding its proposed fee increase to ₹5,500. The assurance was made during a hearing of a plea challenging the raised fee charges. Currently, the Bar Council of Uttarakhand charges ₹1,750 for complaints related to professional misconduct, as the proposed fee increase is still under consideration by the BCI. The Court's order stated that the Bar Council of Uttarakhand will not charge complainants beyond ₹1,000 for entertaining complaints against professional misconduct, along with an additional ₹750 for the cost of service of process, unless the proposed fee increase is approved by the Bar Council of India. However, the petitioner argued that the Council was not transparently separating the ₹1,750 fee and not disclosing that ₹750 was being charged for the cost of service of process. The Court directed the respondent-Bar Council of Uttarakhand to file a specific affidavit within two weeks, detailing the number of cases in which the ₹5,500 fee was charged and from whom. The next hearing is scheduled for September 21.
