Trishul Media's Urgent Relief Plea for Credits in Adipurush Denied by Bombay High Court

The Bombay High Court declined to provide urgent relief to Trishul Media Entertainment, a VFX studio claiming credits in the upcoming film Adipurush, set to release on June 16, 2023.

Justice RI Chagla, presiding over a single-judge bench, was informed that Super Cassettes Pvt Ltd (commonly known as T-Series), a co-producer, had not been included as a party to the lawsuit, although it was a necessary party.

T-Series, represented by advocate Mayur Khandekar, argued that without its involvement, the court could not entertain the plea for urgent relief to halt the film's release.

Advocate Abhinav Chandrachud, appearing on behalf of Trishul, stated that the company no longer wished to pursue a stay on the film's release.

Considering this, the judge granted the defendants time to file their responses and scheduled the next hearing for July 17.

In its lawsuit, Trishul claimed it had entered into VFX studio agreements with Retrophiles Private Limited, the film's producer.

Through their application, Trishul also sought payment of dues amounting to ₹4,77,31,321, including damages incurred by Trishul.

The application, filed by Gandhar Raikar and Sanket Singh, expressed concerns that the production company had been established solely for the film and might likely dissolve after its release.

During discussions regarding payment, Retrophiles allegedly refused to provide any credits to Trishul.

Trishul argued that it would be unable to enforce its rights or receive payment after the film's release.

Based on these grounds, Trishul filed the application seeking urgent relief.

Trishul urged the court to instruct Retrophiles to acknowledge the VFX studio's contributions in the film and requested a stay on the film's release until the credits were duly incorporated.

Furthermore, Trishul sought an order for the deposit of the money owed to them as per the agreements between the parties.

Senior Advocate Ashish Kamath, briefed by Naik Naik & Co., countered the claims by stating that Trishul had already received credit for character assets. He submitted a photograph as evidence.

The court accepted the evidence and acknowledged that the issue of credits had been addressed.

The court then granted Retrophiles time to respond to Trishul's request for payment of dues.

Advocates Ameet Naik, Madhu Gadodia, and Deepak Deshmukh from Naik Naik & Co. also assisted Kamath in presenting the case.
