The bail condition imposed by the Madhya Pradesh High Court, which required the accused person to deposit ₹50 lakhs for his release on bail, has been removed by the Supreme Court.
Justices S Ravindra Bhat and Aravind Kumar, presiding over the case of Mohanlal Maliwad vs State of Madhya Pradesh, acknowledged that the accused had been unjustly incarcerated for nearly 3 years due to this condition. The court observed that the charge-sheet had been filed and the trial had already commenced.
Consequently, the petitioner has been directed to be released on bail without the condition imposed by the High Court.
This decision was made during the hearing of an appeal filed by the accused against a January 2021 order from the Indore bench of the Madhya Pradesh High Court, which had granted him bail on the condition of paying ₹50 lakhs.
The apex court allowed the appeal and ordered the accused's release on bail without the condition. T
he accused was represented by advocates Sarvam Ritam Khare, Jayasree Narasimhan, and Akash Shukla, while the Madhya Pradesh government was represented by Government Advocate Abhimanyu Singh, along with advocates Bhagwan Jee Thakur and Pashupathi Nath Razdan.
