The Punjab and Haryana High Court recently expressed disapproval of a plea for protection submitted by a divorced woman and a married man who were cohabiting.
Justice Alok Jain stated that the man's wife and children were experiencing the negative consequences of the petitioners' unlawful and promiscuous relationship. Consequently, the petition was dismissed, and the two petitioners were instructed to pay ₹25,000 to the man's wife.
Justice Jain remarked, "This petition has been filed solely to conceal the petitioners' illicit and promiscuous relationship by misusing and exploiting the legal process."
The divorced woman, aged 49, approached the Court with her partner, a 33-year-old man who was already married to another woman.
The petitioners claimed that the man's wife had visited their residence and caused a disturbance. They further alleged that the wife had defamed the man's partner by making false and baseless accusations in public. The petitioners also stated that they had received threats.
However, upon reviewing the petition, the Court determined that the submissions did not demonstrate any threat to the couple's life and freedom.
Consequently, the Court concluded that the petition lacked merit and dismissed it, ordering the petitioners to pay ₹25,000 to the man's wife.
The payment must be made within four weeks, and the man's wife was instructed to establish a fixed deposit in a nationalized bank in their daughter's name.
Justice Jain had recently declined to grant police protection to another cohabiting couple, noting that one of the individuals involved was married to someone else.
Advocate Chanpreet Singh represented the petitioners in the current case, while Deputy Advocate General PS Grewal represented the State.
