"Justice Prashant Kumar Mishra Recuses from Umar Khalid's Delhi Riots Bail Plea in Supreme Court"
In a recent development, Justice Prashant Kumar Mishra of the Supreme Court has stepped aside from presiding over the bail plea submitted by Umar Khalid, the prominent Jawaharlal Nehru University (JNU) student and activist, in connection with the Delhi Riots conspiracy case [Umar Khalid vs State of NCT of Delhi].
Scheduled for this morning, the case was set to be heard by a bench comprising Justices AS Bopanna and Mishra.
As a consequence of Justice Mishra's recusal, the case will now be reassigned to another bench within the Supreme Court.
Umar Khalid had moved the highest court to challenge a Delhi High Court ruling from October 2022, which had denied him bail.
Umar Khalid's arrest dates back to September 2020 when the Delhi Police took him into custody on charges of criminal conspiracy, rioting, unlawful assembly, along with various other offences under the Unlawful Activities (Prevention) Act (UAPA).
Since his arrest, Khalid has remained incarcerated.
Previously, a Karkardooma court had rejected his bail plea in March 2022. Following this, Khalid had approached the High Court, where his plea for relief was also denied. This denial prompted his appeal before the Supreme Court.
In May of the current year, the apex court had issued notice to the Delhi Police regarding the bail application.
