Solicitor General Tushar Mehta Raises Concerns Over Yasin Malik's Court Appearance, Warns of Possible Escape or Harm

"Solicitor General Raises Grave Security Concerns Over Yasin Malik's Presence in Supreme Court" 

On Friday, Solicitor General Tushar Mehta wrote a strongly worded letter to Home Secretary Ajay Bhalla, expressing serious apprehensions about Yasin Malik's appearance in the Supreme Court. Mehta stated that Malik's presence was a significant security lapse, as the convicted terrorist could have potentially escaped or faced harm during his transportation to the Court.

Yasin Malik appeared before the top court in response to an appeal filed by the Central Bureau of Investigation (CBI), challenging a special Jammu court's order for his physical presence during trial proceedings in Jammu. The situation caused consternation when the case was heard on Friday morning.

Mehta informed the Home Secretary that neither the Supreme Court had sought Malik's personal presence nor had any authority been granted to produce him in court. The SG learned that Malik was brought based on a general notice sent to all litigants by the Supreme Court, but such a notice does not authorize the personal production of a concerned litigant.

The letter further highlighted that an order by the Home Ministry under Section 268 of the Code of Criminal Procedure (CrPC) specifically bars jail authorities from bringing Malik out of jail for security reasons. Despite this, jail authorities brought Malik to court, putting the Supreme Court's security at serious risk.

Mehta urged the Home Secretary to take appropriate action to address the security lapse and emphasized that the matter required urgent attention. The case in question pertains to Malik's appearance for cross-examination in two cases: the killing of four IAF personnel and the abduction of Rubaiya Sayeed, daughter of former Chief Minister Mufti Muhammad Sayeed, in 1989. The Supreme Court had issued a notice in April and stayed the orders directing Malik's physical presence.
