Shahrukh Pathan, the individual who was observed brandishing a firearm at a police officer during the Delhi riots of 2020, has been granted bail by a Delhi court in a separate case related to the riots.
He was granted bail in a case pertaining to the infliction of injuries upon numerous police personnel and causing a gunshot wound to an individual named Rohit Shukla during the clash between protestors both in favor and against the Citizenship Amendment Act (CAA).
However, Pathan will remain incarcerated as he has yet to secure bail in the case registered for his act of pointing the gun at the police officer.
Additional Sessions Judge (ASJ) Amitabh Rawat of the Karkardooma court granted bail to Pathan in the case involving the gunshot injury after taking into account that he has been in judicial custody since April 2020 and that the other co-accused have already been granted bail.
The Court further observed that in the present case, Pathan is not accused of directly shooting at Rohit Shukla, but rather of being part of the riotous mob that fired shots at Shukla.
"The court acknowledges the fact that the accused's behavior in this case, both prior to his arrest and during the trial, while in judicial custody, has been deplorable. However, it remains a fact that he has been in judicial custody since 3rd April 2020... The court is also aware that accused Shahrukh Pathan is involved in another riot case, FIR No.51/2020 PS Jafrabad, where he is alleged to have made an attempt on the life of a police official. However, that case will be dealt with based on its own merits," concluded the Court.
Consequently, the Court ordered the grant of bail to Pathan, subject to him furnishing a bond of ₹50,000.
Pathan stands accused of multiple offenses, including rioting and unlawful assembly promoting enmity between different groups.
In December 2021, charges were framed against him under Sections 147, 148, 149, 186, 188, 153A, 283, 353, 332, 323, and 307 of the Indian Penal Code.
