A Mumbai Court extended the remand of Dewan Housing Finance Limited (DHFL) promoters Kapil and Dheeraj Wadhawan till June 20. The Wadhawan brothers are currently in judicial custody following their arrest in a ₹3,700 crore loan scam case involving Yes Bank. They had requested the court to transfer them to Arthur Road jail instead of being remanded to Taloja Central Prison.
However, Judge MG Deshpande rejected their plea and directed that they be sent back to Taloja Central Prison. The court stated that the decision of which jail the accused should be kept in falls under the jurisdiction of the jail authorities. Granting such requests would unnecessarily interfere with jail administration.
The court also took into account the information provided by the jail authorities regarding the lack of space in Arthur Road jail and the better facilities available at Taloja prison for accommodating the accused.
Senior advocate Aabad Ponda, representing the accused, argued that one of them was under medical treatment at the All India Institute of Medical Sciences (AIIMS) in Delhi. However, the court found no merit in this submission since both of the accused had been produced from Tihar jail, not AIIMS.
The judge noted from the case documents that while in Taloja Jail, Dheeraj had been admitted to a private hospital for a significant period. The court had to order his discharge from the hospital after reviewing reports from a Mumbai court.
The court emphasized that Taloja Central Prison would ensure the utmost care for the health of the accused, as they had received the best available medical aid during their previous stay in the same facility.
The plea was disposed of by the court based on these considerations.
