Kerala High Court Upholds Privacy as Constitutional Core of Human Dignity, Orders Removal of Woman's Images from Online Media Platforms
In a recent ruling, the Kerala High Court emphasized the fundamental importance of privacy as the constitutional core of human dignity. The court issued an order for the immediate removal of images belonging to a woman, who was named as a victim in an immoral trafficking case, from various online media platforms. The court highlighted that privacy is not only a constitutional value but also the ultimate expression of an individual's sanctity and dignity.
The order, delivered by Justice K Babu, was in response to a plea filed by the woman. She claimed that her personal information, including her name, images, and identity, had been uploaded and circulated on platforms like YouTube in connection with the case registered under the Immoral Traffic (Prevention) Act, 1956. Despite being recognized as a victim, she faced cyber-attacks, humiliation, and damage to her professional practice due to the dissemination of these images.
The petitioner further alleged that her complaints to the authorities yielded no action to remove the offensive content. Consequently, she approached the Kerala High Court seeking directions for the removal of such content. Responding to her plea, the court ordered the State Police Chief to take immediate steps to eliminate the woman's images from online media platforms.
The court will review the matter again on June 27. Advocate PT Sheejish represented the petitioner in the case.
