Kerala High Court Directs Contemnor to Release Apology Video on YouTube Amidst Allegations Against Judges

The Kerala High Court has issued an order to KM Shajahan, the former private secretary of former Chief Minister VS Achuthanandan, to publish an apology video on his YouTube channel. The court found Shajahan guilty of contempt of court for making objectionable comments against the judges of the High Court. The division bench of Justices PB Suresh Kumar and CS Sudha passed the order after Shajahan expressed his readiness to file an unconditional apology, although his affidavit stated that he had not committed any contempt of court. According to the court's ruling, Shajahan must stream a video on his YouTube channel expressing regret for his objectionable remarks and admitting that he has committed contempt of court. The order is in line with Rule 14(a) of the Contempt of Courts (High Court of Kerala) Rules. Shajahan had previously streamed a video on his channel making derogatory comments about the judges of the High Court. On June 5, the court granted Shajahan the opportunity to file an unconditional apology and scheduled a hearing for June 6. However, Shajahan did not appear in court on June 6, leading to an adjournment of the case to June 8. On June 8, the court examined Shajahan's affidavit, which did not contain an unconditional apology. Instead, Shajahan justified his conduct in the video, stating that it aimed to expose an erroneous judicial order. The court rejected Shajahan's affidavit as it did not comply with Rule 14(a) of the Contempt of Courts (High Court of Kerala) Rules. In response, Shajahan expressed his willingness to file an unconditional apology, expressing regret for his remarks against the judges. He also agreed to stream a video on his YouTube channel, retracting the allegations and expressing remorse for sharing the objectionable content. The court accepted Shajahan's proposal and directed him to follow through with the apology video. The case is scheduled for further consideration on June 15. The court also instructed Shajahan to provide the details of the video link and a copy of the video on an electronic device before the next hearing.
