Gujarat High Court Orders Probe into Doctor's Alleged Issuance of Bogus Medical Certificates to Facilitate Prisoners' Bail

In a recent development, the Gujarat High Court has directed the Surat Police to initiate an investigation against a doctor who is accused of issuing fraudulent medical certificates to jail inmates to help them obtain bail. The order was issued by Justice MK Thakker, who was presiding over a bail application filed by Dilip Gauda. Gauda had submitted a medical certificate from Dreamz Multi Specialty Hospital, signed by Dr. ML Patel, to support his bail plea.

During the hearing, the Court took note of certain observations made by a trial court on May 22 regarding the medical certificates issued by Dr. Patel. The trial court pointed out that the certificate mentioned Dr. Patel's degrees as MBBS and MRSM (Member of the Royal Society of Medicine), which is an institution based in the United Kingdom. The trial court concluded that MRSM is not a degree but rather a membership of that institution. Moreover, the court noted that an MBBS degree holder is not authorized to perform surgeries, while Dr. Patel's certificate recommended surgery.

Furthermore, the trial court highlighted that Dr. Patel had a pattern of issuing medical certificates in the names of different hospitals, including Aarzoo, Shri Hari, and Dreamz, to assist prisoners in applying for bail. The certificates mentioned different addresses, and it was also revealed that Dr. Patel has a criminal history involving charges of rape, cheating, forgery, and even offenses under the Motor Vehicles Act.

Based on these findings, the High Court opined that prima facie evidence suggests that Dr. ML Patel has been issuing fraudulent certificates under different hospital names and addresses. The court ordered the concerned Investigating Officer to verify and examine the certificate issued by Dr. Patel, aiming to bring forth the accurate and true facts of the case. The matter is scheduled to be heard next on June 8.

During the proceedings, the petitioner was represented by advocates Amit Shah and Khushbu Shah, while the State was represented by Additional Public Prosecutor Bhargav Pandya.
