Delhi High Court Urges Update of Patent Manual to Address Complex AI and Machine Learning Technologies

In response to the rapid advancements in artificial intelligence (AI) and machine learning technologies, the Delhi High Court has directed the Patent Office to update the Manual of Patent Office Practice and Procedure. The court's decision came in the case of AGFA NV & Anr v The Assistant Controller of Patents and Designs & Anr.

The court recognized that patent applications in the domains of AI and machine learning often involve numerous interlinked features and a large number of claims. Acknowledging the increasing number of patent filings in India and the need for better guidance for examiners and controllers, the court emphasized the necessity of updating the manual. This update would provide clearer guidelines for dealing with complex patents, including those related to AI systems, machine learning functions, agrochemicals, pharmaceuticals, and manufacturing methods.

Furthermore, the court suggested providing technical and patent analytics training to examiners and controllers to enhance their ability to assess clarity and succinctness of inventions.

The case itself involved AGFA NV's appeal against the rejection of their patent application titled 'Manufacturing of Decorative Laminates by Inkjet.' The court found that the rejection lacked reasoning regarding novelty or inventive features. Additionally, it noted that the same patent had been granted in various other jurisdictions worldwide.

Consequently, the court set aside the previous order and directed the Patent Office to grant the patent upon completion of necessary formalities. The matter was listed for further proceedings before the Patent Office on June 14, 2023.

The court's decision underscores the importance of adapting patent regulations to accommodate the complexities arising from AI and machine learning technologies. By updating the Patent Manual, the Delhi High Court aims to equip examiners and controllers with better tools for evaluating patent applications in these rapidly evolving fields.
