
The Delhi High Court has reserved its decision on a plea seeking directions to the police to ask complainants if they are willing to undergo narco analysis, polygraph, and brain mapping tests to prove the veracity of their complaints. The PIL was filed by BJP leader Ashwini Upadhyay, who argued that such tests would deter the filing of false rape, dowry, and SC/ST cases. However, the court stated that the prayers sought would involve changes to the Code of Criminal Procedure (CrPC), and such directions cannot be passed by the court. The bench emphasized that they are not lawmakers and will not go beyond the CrPC. Upadhyay clarified that he is not seeking directions to the Central government but a report by the law commission on controlling fake cases. The Court said it would pass appropriate orders in the matter.
