The Delhi High Court has ordered the Election Commission of India to make a decision on the representation made by All India Anna Dravida Munnetra Kazhagam (AIADMK) regarding the update of its amended by-laws within ten days. This direction was given by Justice Purushaindra Kumar Kaurav during a hearing on Wednesday. The ECI's representative informed the court that they will take the necessary action on the representation within the stipulated time frame. The plea was filed by the political party and its interim General Secretary, Thiru K Palaniswamy, requesting the ECI to consider their representation and update its records with the latest amended by-laws dated July 11, 2022. After hearing both sides, the court disposed of the plea.
During the hearing, Justice Kaurav allowed the counsel representing former Chief Minister of Tamil Nadu, O. Panneerselvan, to intervene in the matter and raise their grievances before the ECI. The AIADMK had claimed that the ECI was violating established legal principles by not updating its records with the latest amended by-laws due to internal disputes within the party. The political party argued that the ECI's inaction would severely impact its democratic functioning as a recognized political party with a significant presence in Karnataka, and would prevent it from participating in elections.
The AIADMK's plea further stated that the ECI's failure to update the amended by-laws would disrupt the party's activities and violate democratic principles. They argued that without updated records, the party would be unable to put forward candidates or carry out any administrative functions. The court was informed that the ECI had assured to take a decision on the representation made by the AIADMK within ten days. After hearing the arguments, the court disposed of the plea.
