Calcutta High Court: No Criminal Intimidation in Immediate Employee Posting Requests

In a recent ruling, the Calcutta High Court emphasized that employers cannot be charged with criminal intimidation or conspiracy solely for urging employees to promptly relocate to their designated work locations. The case in question, titled "Debarati Banerjee vs State of West Bengal," centered on the HR manager of IDBI Bank and his alleged involvement in a criminal conspiracy.

Justice Ajoy Kumar Mukherjee, presiding over the case, delivered the verdict, quashing the criminal charges against the HR manager. The Court held that a bank's decision to transfer an employee according to its established transfer policy does not qualify as criminal intimidation under Section 506 of the Indian Penal Code (IPC). Such an action, the Court noted, does not constitute a threat to the individual's reputation or property.

Moreover, the Court expounded that directing an employee to immediately assume duties at a new posting does not fall within the purview of criminal intimidation or conspiracy. The judgment emphasized that the core aspects of these offenses were absent in the case at hand.

The origins of the case lay in accusations made by an assistant manager against the HR manager, alleging a plot to tarnish his reputation and orchestrate his transfer from Birbhum district, West Bengal, to Tripura. The complainant had implicated the HR manager and others in charges of criminal conspiracy (Section 120B) and criminal intimidation (Section 506) under IPC.

The HR manager's defense hinged on revealing the complainant's prior misconduct of sexually harassing a female officer, which led to his transfer to Tripura as an administrative decision. Notably, the bank's established transfer policy also aligned with the complainant's relocation based on years of service.

Highlighting the miscarriage of justice, the High Court denounced the magistrate's actions in entertaining the complaint and issuing the summons. The Court deemed the magistrate's order deficient in establishing a prima facie case against the manager and criticized the issuance of summons without proper verification of the allegations.

The verdict underscored the magistrate's pivotal role in scrutinizing preliminary depositions and thoroughly evaluating the veracity of claims before initiating legal proceedings. It stressed that the magistrate should exercise discretion and not merely act as a passive observer.

The legal representation in the case was provided by advocates Ayan Bhattacharya, Arindam Dutta, Kausik De, Mohini Majumder, and Raghav Munshi on behalf of the HR manager. Advocates Prosenjit Mukherjee, Nirmalya Kumar Das, and Poulami Dutta represented the complainant.

In conclusion, the Calcutta High Court's decision clarifies that seeking an employee's immediate transfer or relocation is not tantamount to criminal intimidation or conspiracy, setting a significant precedent in employment-related legal matters.
