The Surat Sessions Court has issued a notice to the complainant, Purnesh Modi, on Rahul Gandhi's plea for a stay on his conviction in the defamation case. While Gandhi's conviction has not been stayed by the court today, the notice asks Modi to file his reply by April 10th. The case revolves around Gandhi's controversial remark during a political campaign in Karol in 2019, where he had questioned, "why all thieves share the Modi surname.
Rahul Gandhi, a prominent Congress leader, has filed an appeal in the Surat Sessions Court today, challenging his recent conviction. Along with the appeal, two applications have also been submitted - one for Suspension of Sentence, which is essentially a regular bail application, and the other for Suspension of Conviction.
If the second application is granted, Gandhi's membership in the Lok Sabha will be reinstated, subject to the issuance of a notification by the LS Secretariat.
On March 23rd, Gandhi was sentenced to two years in jail by the Court of Chief Judicial Magistrate, which led to his disqualification as an MP of the Lok Sabha. However, he was granted bail, and his sentence was suspended, allowing him to file an appeal against his conviction within 30 days.
