Bengaluru Court Grants Release of 'Hostel Hudugaru Bekagiddare' Film After ₹50 Lakh Deposit by Makers

"Hostel Hudugaru Bekagiddare Film Release Allowed by Bengaluru Court After ₹50 Lakh Deposit by Producers

Bengaluru's commercial court has granted permission to the producers of 'Hostel Hudugaru Bekagiddare' to release the film on Friday, following a ₹50 lakh deposit. The court had previously restrained the film's release based on a prima facie case of breach of contract filed by actor Divya Spandana. Spandana alleged that her clips were used in the trailer and film without her consent.

While acknowledging the breach of contract, the court highlighted that it could be remedied with monetary compensation. The film's trailer had already garnered 42 lakh views, and its scheduled release was imminent.

The lawsuit accused the filmmakers of violating an artist agreement from April 2022 and infringing upon Spandana's publicity and moral rights under the Copyright Act, 1957. She sought a permanent injunction to prevent her clips from being used in any film trailers or the movie itself, which was originally slated for release on July 21.

The filmmakers' counsel argued that they were within their rights as per the artist agreement, where the producer held the final authority for creative decisions. They further asserted that editing the film to remove the clips would require approval from the censor board, causing significant delays.

However, the court ruled that the clause in the agreement concerning creative decisions did not absolve the filmmakers of obtaining consent for using the actor's clips.

While acknowledging the prima facie breach of contract, the court recognized the irreparable harm that could be caused to the filmmakers and theaters if the film's release was halted. Consequently, the court directed the producers to deposit ₹50 lakh as security to proceed with the scheduled release."
