Allahabad High Court Slaps ₹10k Fine on Woman for Filing False Rape Case Against Man, Who She Later Married

The Allahabad High Court has recently dismissed a rape case that was filed by a woman against a man, citing the false nature of the initial complaint and highlighting the subsequent marriage between the two individuals. In the case of Shivam Kumar Pal v State & Ors, the court not only quashed the baseless First Information Report (FIR) but also imposed a fine of ₹10,000 on the woman, emphasizing the need to address the concerning trend of unwarranted accusations of rape by women.

The court's decision, delivered on July 27, was issued by a Bench comprising Justice Anjani Kumar Mishra and Justice Vivek Kumar Singh. The judges underscored that employing the criminal justice system as a means to settle personal disputes is unacceptable. They firmly asserted that making fictitious rape allegations and utilizing FIRs as instruments for personal vendettas must be met with severe consequences.

This ruling stemmed from a plea filed by Shivam Kumar Pal, who was accused of rape (Section 306 IPC), criminal breach of trust (Section 406 IPC), and criminal intimidation (Section 506 IPC). Pal vehemently denied the allegations, asserting that the FIR was a fabrication and that he and the complainant had voluntarily married and were harmoniously living as a married couple.

Supporting Pal's stance, the complainant's counsel also agreed that the allegations were unfounded. Additionally, the court took into account a letter from the woman to the Commissioner of Police, Prayagraj, wherein she confessed that the FIR had been filed hastily and was untrue.

After a thorough examination of the evidence presented and careful consideration of both parties' arguments, the court concluded that the false FIR was lodged with the intention of pressuring the accused and settling scores. Consequently, the court not only dismissed the case but also ordered the woman to pay a fine of ₹10,000 within ten days. Failure to comply would result in the fine being collected as arrears of land revenue from the woman.

The Allahabad High Court's decision serves as a strong message against the misuse of the legal system for personal motives and underscores the importance of upholding the integrity of the criminal justice process.
