Allahabad High Court Forms Committee to Probe Police Lathi Charge on Lawyers in Hapur

During a special session convened on a Saturday, the Allahabad High Court established a committee to investigate a recent incident involving a police baton charge against lawyers in the Hapur district. This case is referred to as "In Re v Bar Council Of UP."

The bench, presided over by Chief Justice Pritinker Diwaker and Justice Mahesh Chandra Tripathi, also entrusted the committee with an application submitted by the Bar Council of Uttar Pradesh, which outlined the grievances raised by lawyers regarding the aforementioned incident.

Heading this investigative committee is Justice Manoj Kumar Gupta, a current judge of the Allahabad High Court. Joining him as committee members are Justices Rajan Roy and Mohd. Faiz Alam Khan, the Advocate General of Uttar Pradesh or their appointee, the chairperson of the Bar Council of Uttar Pradesh, and the president of the High Court Bar Association.

Additionally, on the same Saturday, the Court directed the Special Investigation Team (SIT) previously formed by the State government to provide information to the bench regarding the actions taken in response to the first information reports (FIRs) lodged by the lawyers involved in the case.

The roots of this issue trace back to a protest initiated by lawyers in response to a police case filed against advocate Priyanka Tyagi. This protest allegedly escalated into a police baton charge against the advocates in Hapur last month. Subsequently, the Bar Council of Uttar Pradesh decided to abstain from judicial work on August 30, extending their strike for an additional three days on September 4, 5, and 6, all in connection to this matter.

The High Court eventually took suo motu cognizance of the ongoing strike and, on September 4, directed the Uttar Pradesh government to include a retired judicial officer named Hari Nath Pandey as a member of the SIT responsible for investigating the case.

The next hearing on this matter is scheduled for September 15. During the proceedings on Saturday, Senior Advocate Anoop Trivedi, along with advocates Abhinav Gaur and Vibhu Rai, represented the Bar Council of Uttar Pradesh.
