Viral Video Sparks Action: NCLT Members in Heated Exchange Face Case Transfers

A video showing a judicial and a technical member of National Company Law Tribunal (NCLT) at Chandigarh engaging in a heated exchange had reported gone viral on social media and messaging apps.The video of the courtroom shows the Member (Judicial) Dr. Patibandla Satyanarayana Prasad and Member (Technical) Umesh Kumar Shukla argue over the way the latter conducts the cases.In the latest development, taking swift and serious note of such unwarranted conduct in public domain by the members of NCLT, using powers conferred under Rule 16(d), (e) and (f) NCLT Rules 2016, competent authority has issued appropriate directions.The competent authority has ordered that pending cases of Bench No. 2 NCLT Chandigarh Bench presided over by Mr .Dr. P. S. N. Prasad, Member (J) and Mr. Umesh Kumar Shukla, Member (T) be withdrawn and transferred to NCLT Bench 1 till further orders.In order to safeguard the interest of litigants it is further order that Bench No. 1, NCLT Chandigarh Bench shall conduct and deal with pending cases of such NCLT Bench 2, Chandigarh until further order.To order to further safeguard the interest of litigants , regarding mature cases pending before the Bench No-II , NCLT , Chandigarh it is order by NCLT that Members of Bench No. 2, NCLT Chandigarh will however pronounce orders in reserved matters, at the earliest.On 03/02/2023 itself a formal order to this effect is issued by the Naveen Kumar kashyap, Registrar , National Company law Tribunal (NCLT)
