"Supreme Court Constitution Bench to Hear Petitions Challenging Article 370 Abrogation After Nearly Four Years"
After nearly four years since the abrogation of Article 370, a Constitution Bench led by Chief Justice of India DY Chandrachud is set to hear a batch of over 20 petitions challenging the Central government's decision. The Bench, comprising Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai, and Surya Kant, will convene on July 11 to address the issue. The hearing will also include a discussion on whether bureaucrat Shah Faesal can withdraw his petition.
These petitions contest the Central government's move to revoke the special status of the erstwhile State of Jammu & Kashmir, leading to its bifurcation into two Union Territories. In March 2020, a five-judge Constitution Bench declined to refer the case to a seven-judge Constitution Bench, stating that there was no conflict between the two relevant judgments on the interpretation of Article 370. The matter was recently mentioned before Chief Justice Chandrachud in February 2023, and now a final hearing has been scheduled.
