In a critical judgment dated October 16, 2024, the Supreme Court of India tended to a debate between IDBI Bank Ltd. and Ramswaroop Daliya & Ors. The case rotated around an sell off deal of a property conducted by the bank, where the respondents were the most noteworthy bidders. The center issue related to the non-issuance of a deal certificate and the ensuing cancellation of the sell off by the bank, driving the respondents to look for help through summons petitions.
The property, found in Telangana, was unloaded in April 2018, with the respondents putting the most noteworthy offered at ₹1,42,50,000. In spite of the fact that they expeditiously paid 25% of the offered sum, the adjust was not acknowledged by the bank, which afterward singularly cancelled the sell off, citing complaints to the Central Bureau of Investigation (CBI) and an admonitory issued by the Enforcement Directorate (ED) as reasons.
The High Court had previously ruled in favor of the respondents and ordered the bank to furnish the sale certificate. IDBI Bank appealed the verdict to the Supreme Court, claiming that the respondents failed to deposit the balance within the 15-day period required by Rule 9(4) of the Security Interest (Enforcement) Rules, 2002.
However, the Supreme Court maintained the High Court's decision, stating that the respondents were always ready and eager to pay the balance but were thwarted by the bank's activities, which included a complaint to the CBI and an ED recommendation. The Court determined that the bank's decision to cancel the auction was arbitrary and contrary to natural justice standards. Furthermore, the cancellation was made without prior warning to the respondents.
The Court expelled the bank's offer and coordinated IDBI Bank to issue the deal certificate after tolerating the adjust installment from the respondents, subsequently confirming their rights as sell off buyers.
