Supreme Court Dismisses Review Petitions Challenging EWS Reservation Verdict
In a significant development, the Supreme Court has rejected the review petitions challenging its earlier judgment that upheld the constitutional validity of the 103rd Constitutional Amendment providing 10 percent reservation for Economically Weaker Sections (EWS) of the society. The bench, consisting of Chief Justice of India DY Chandrachud and Justices Dinesh Maheshwari, S Ravindra Bhat, Bela M Trivedi, and JB Pardiwala, concluded that there were no errors in its November 2022 judgment.
The Court further declined the request for an open court hearing of the review petitions. The Constitution Bench's earlier decision, delivered on November 7 last year, had upheld the legality of EWS reservation. However, it was not a unanimous ruling, with then Chief Justice of India UU Lalit and Justice Ravindra Bhat expressing dissenting opinions.
The dissenting judges contended that while economic-based reservation is permissible, excluding Scheduled Castes/Scheduled Tribes (SC/ST) and Other Backward Classes (OBC) from EWS reservation would amount to discrimination against them. The review petitions were filed by Madhya Pradesh Congress leader Dr. Jaya Thakur and the Dravida Munnetra Kazhagam (DMK) party.
With the dismissal of the review petitions, the Supreme Court's verdict on EWS reservation stands firm, ensuring continued implementation of the reservation policy for the benefit of economically weaker sections of society.
