Supreme Court Seeks Assam Government and NHRC Response on Plea for Probe into Alleged 'Fake Encounters'
The Supreme Court has requested the Assam government and the National Human Rights Commission (NHRC) to provide a response regarding a plea alleging fake police encounters in the state. The plea, titled Arif Yeasin Jwadder v. State of Assam and Ors, was presented by Advocate Arif Yeasin Jwadder, with representation by Advocate Prashant Bhushan.
Jwadder approached the Supreme Court after the Gauhati High Court declined to order an independent investigation into encounter killings in Assam. The petitioner sought the registration of a First Information Report (FIR) against police personnel under Section 302 of the Indian Penal Code for murder related to the alleged fake encounter killings. Additionally, the petitioner called for the establishment of Human Rights Courts in Assam, as mandated under Section 30 of the Protection of Human Rights Act.
According to the petitioner, more than 80 police encounters have taken place since May of the previous year, resulting in the deaths of 28 individuals and injuries to 48 others in these alleged "fake encounters."
However, the Gauhati High Court dismissed the plea, criticizing the petitioner for basing the petition on media reports and making vague assertions. The court remarked that the petitioner, despite being a practicing lawyer, appeared to have hastily approached the court without verifying the complete facts. The court suggested the petitioner may have sought publicity through the petition.
