"Supreme Court Orders Ford India to Pay Rs 42 Lakhs as Compensation to Ford Titanium Endeavour Owner for Manufacturing Defects"
In a recent verdict, the Supreme Court of India has ruled in favor of a consumer who faced numerous manufacturing defects in their Ford Titanium Endeavour 3.4L car. The owner had initially lodged a complaint with the Punjab State Consumer Commission, highlighting issues such as oil leakage right from the start of vehicle usage. The State Commission had ordered Ford India to replace the engine at no cost and pay a daily compensation of Rs. 2,000. This decision was subsequently upheld by the National Commission.
However, even after the engine replacement, the car continued to exhibit problems that rendered it unfit for proper use. The owner complained of various issues that made driving the vehicle challenging. Ford India, during the course of the appeal before the Supreme Court, had already replaced the engine, but the problems persisted.
Considering the aforementioned circumstances, a bench comprising Justices Surya Kant and Dipankar Datta ruled that Ford India should compensate the owner with a total amount of Rs. 42 lakhs. As Ford had already paid Rs. 6 lakhs as per the State Commission's order, they were required to pay the remaining Rs. 36 lakhs. Furthermore, an additional sum of Rs. 87,000 was to be paid by Ford towards the insurance of the vehicle.
Upon receiving the compensation amount of Rs. 36,87,000, the owner is obligated to hand over the vehicle to the company. This landmark judgment by the Supreme Court holds Ford India liable for the manufacturing defects in their car and highlights the importance of consumer protection in such cases.
