Supreme Court has agreed to form a three-judge bench to review a verdict that granted an accused person the right to default bail if the investigating agency files an incomplete chargesheet. The ruling, which came in the case of Ritu Chhabaria v. Union of India, stated that default bail is not only a statutory right but also a fundamental one guaranteed by Article 21 of the Constitution. However, the Central government filed an application for the recall of the verdict, claiming that it failed to consider a prior binding decision in the Dinesh Dalmia case. The Solicitor General of India argued that several cases are being filed based on the Ritu Chhabaria judgment, prompting the court to order all courts to defer applications based on the ruling until after May 4.
Advocates Zoheb Hossain, Arvind Kumar Sharma, Kanu Agrawal, Ankit Bhatia, and Vivek Gurnani filed the Central government's recall plea, which was heard by the Supreme Court on Monday. The plea was presented by Solicitor General Tushar Mehta and Additional Solicitor General SV Raju during the hearing.
