The Supreme Court of India has granted interim protection from arrest to a doctor, Dr. Abdul Qadir, who is facing accusations of rape by a Hindu woman. The case revolves around a controversial relationship where the accused allegedly misled the woman by promising marriage.

A bench comprising Justices Aniruddha Bose and Rajesh Bindal directed the Uttar Pradesh government to respond to the matter. The court also issued a directive prohibiting the accused from entering Muradabad, the location where the case was filed, until the next hearing.

During the proceedings, the complainant's counsel, advocate Purnima Jauhari, opposed the plea for interim relief. She raised concerns about the alleged "love jihad" angle and claimed that the accused had established sexual relations with the woman under false pretenses. Jauhari expressed fears for the complainant's safety and questioned who would protect her.

After hearing arguments from both sides, the Court decided to grant interim protection to the accused.

"We grant interim protection from arrest to the petitioner in the case registered in Muradabad until the next date of hearing. The petitioner shall not enter Muradabad till the next date of hearing and shall not enter into any communication directly or indirectly with the complainant. Issue notice. Returnable in 4 weeks."

Dr. Abdul Qadir had approached the Supreme Court after the Allahabad High Court denied him anticipatory bail on May 10. The petition, filed by advocate G Indira, claimed that the complainant's lawyer was the mastermind behind a conspiracy against the accused. The petition further alleged that the lawyer had extorted ₹1.65 lakh from Dr. Qadir to secure his release from illegal detention by the police.

The plea argued that the complainant and the accused had been in a consensual live-in relationship since 2019, and their friends were aware of the accused's marital status, as he already had a wife and daughter. It also claimed that the woman had attempted to blackmail the accused for ₹1 crore after their relationship turned sour, falsely accusing him of posing as a Hindu man.

The plea criticized the High Court and Sessions Court for not considering these facts and circumstances. It contended that the allegations of rape were false and lacked evidence.
