In a eminent judgment, the Rajasthan High Court allowed an arms permit to Yagyajeet Singh Chauhan, a national-level shooter, expelling the state's complaints over her family background. The case centered around the petitioner's numerous endeavors to get an arms permit for wearing purposes, which had been over and over denied by the specialists on grounds of open security concerns tied to her family's history of criminal exercises.
The applicant, a famous shooter, had applied for an arms permit to advance her cooperation in national and universal shooting competitions. In spite of giving all essential documentation, counting police confirmation and certification from the National Rifle Association of India, the Area Magistrate rejected her application, citing concerns over her family ties to people with criminal records. The specialists contended that allowing her a permit may posture a risk to public safety under Section 14(1)(b)(ii) of the Arms Act, 1959.
In its ruling, the Rajasthan High Court, however, determined that these objections lacked merit. The case's judge, Dinesh Mehta, observed that the petitioner shouldn't be punished because of her family history because she didn't have a criminal record. He stressed that the petitioner's unique quality as a sports shooter who doesn't engage in illegal activity was reason enough to give the license.
The Court further highlighted that the dismissal of her application damaged her principal rights under Article 14 (Right to Equality) and Article 19(1)(g) (Right to Practice Any Profession) of the Constitution of India.
As a result, the Court subdued the District Magistrate's order and coordinated the specialists to issue a permanent arms permit to the applicant inside ten days.
This administering underscores the significance of assessing people on their own merits, especially when managing with issues like arms licenses for competitors, and dismissing choices based exclusively on familial associations.
