MP High Court Sends Notice to NBEMS Over NEET PG Admission Revocation Due to Vacancy Chart Error.

MP High Court sends notice to NBEMS and other authorities in a writ petition challenging NEET PG seat cancellation due to alleged excess seat admission.

The Division Bench, comprising Chief Justice Ravi Malimath and Justice Vishal Mishra, has also notified Bundelkhand Medical College in the case, with a return date set for two weeks.

The writ petition challenges the cancellation of the petitioner-doctor's M.S. in Oto-Rhino-Laryngology (ENT) admission at Bundelkhand Medical College. The petitioner secured a seat in the second Mop up round on 29.09.2023 after passing NEET PG and successfully completing counseling. He claims that his admission to the Scheduled Caste quota seat was revoked after completing all formalities, including paying a Rs 2 lakh fee. The Director of Medical Education in MP reportedly cited an 'error in the vacancy chart' as the reason for rejecting the admission on 08.10.2023.

The writ petition challenges the order, contending that the admission cancellation deprived the petitioner of a valuable education opportunity as a postgraduate student. The petitioner argues that the respondent authorities' error should not justify compromising the career aspirations of a deserving candidate. The petition also highlights that candidates with lower ranks than the petitioner have been admitted to various postgraduate programs, raising concerns about the fairness of the decision.

The petitioner's counsel argued that since the respondents acknowledged their own error, the admission of all candidates with lower ranks should have been revoked as well. Failing to do so constitutes a violation of the petitioner's right to equality. Moreover, making the petitioner eligible for a subsequent Mop up round after canceling his previously granted admission has unfairly placed him at the bottom of the list of eligible students, the petitioner's counsel added.

In the writ petition, the petitioner requests permission to resume their post-graduation studies in MS (ENT) at Bundelkhand Medical College. Additionally, the petitioner seeks interim relief by suspending the admissions of candidates with lower ranks. Alternatively, the petitioner asks to be allowed to pursue the course in any other medical college within the state of Madhya Pradesh.
