The Delhi High Court recently restrained salon chain Geetanjali Salon from playing songs in which Phonographic Performance Limited (PPL) holds the copyright without obtaining license [Phonographic Performance Limited v Geetanjali Salon Private Limited & Ors].Justice Anish Dayal passed an ex-parte ad interim order noting that PPL has made a prima facie case for grant of injunction and that it will suffer irreparable harm in case the same is not provided.“Defendants, its directors, partners or proprietors, and any other person working for and on their behalf are restrained from exploitation/ use of plaintiff’s copyrighted works in the repertoire available on plaintiff’s website https://www.pplindia.org/songs at any of its premises including but not limited to the list of outlets which have been made a part of documents of the present suit, which amounts to infringement of plaintiff’s copyright,” the Court ordered.PPL moved the Court alleging copyright infringement arguing that Geetanjali is playing the songs without obtaining license and this amounts to infringement.They provided details of 25 Geetanjali salons which were allegedly playing PPL’s songs without authorisation.Phonographic Performance Limited was represented by Senior Advocate Chander M Lall along with the team of Khaitan & Co led Mr Ankur Sangal, Partner, Raghu Vinayak Sinha, Associate and Shaurya Pandey, Associate.
