"Central Government Files Review Petition against Supreme Court's Delhi Services Control Ruling"
The Central government has lodged a review petition with the Supreme Court challenging the recent verdict that granted control of services in Delhi, including Indian Administrative Service (IAS) officers, to the Delhi government, except for matters related to land, police, and law and order.
On May 11, a Constitution Bench of the Supreme Court ruled unanimously that the elected state governments' governance cannot be superseded by the Central government. The judgment specified that the Delhi government would exercise authority over all services, with exceptions for land, police, and law and order.
Chief Justice of India (CJI) DY Chandrachud and Justices MR Shah, Krishna Murari, Hima Kohli, and PS Narasimha formed the Constitution Bench, which determined that the legislative power of NCT Delhi extends to IAS officers, even if they are not recruited by the Delhi government. However, the ruling clarified that land, law and order, and police services would fall outside the purview of the Delhi government's control, with the Lieutenant Governor (LG) being bound by the decisions of the NCT Delhi regarding services, except for the mentioned exceptions.
The Central government has now taken the step to challenge this ruling through a review petition.
This development follows the recent issuance of an ordinance by the President of India, granting overriding powers to the LG of Delhi, who is the representative of the Central government, in matters of civil servant transfers, postings, and disciplinary proceedings. The ordinance was introduced to counter the Supreme Court's judgment.
