In October 2023, the Supreme Court Collegium, led by Chief Justice of India Dhananjaya Y. Chandrachud and consisting of Justices Sanjay Kishan Kaul and Sanjiv Khanna, had proposed Rudra Prakash Mishra and Ramesh Chand Malviya as candidates for the position of Judges at the Patna High Court.
The Collegium, in its resolution dated October 17, 2023, specified that the Chief Justice of the Patna High Court, in consultation with the two most senior colleagues, endorsed the promotion of the two judicial officers to the position of Judges in the High Court of Judicature at Patna. Additionally, the Chief Minister and the Governor of the State of Bihar have also expressed their agreement with this recommendation.
