Bengaluru court grants bail to three accused of shouting Pakistan Zindabad slogans at Vidhana Soudha

A trial court in Bengaluru has granted conditional bail to three individuals who were arrested in connection with allegations that they raised "Pakistan Zindabad" slogans at Vidhana Soudha (Karnataka's legislative house). The alleged incident took place following the victory of Congress candidate Syed Naseer Hussain in the Rajya Sabha elections.Additional Chief Metropolitan Magistrate (ACMM) V Vijith allowed the bail application moved by the accused persons, Mohammad Iltaz of Kishanganj, Mohammad Shafi Nashipudi, and DS Munawar Ahmed. The trial court has ordered all three accused persons to furnish a bond of ₹1 lakh and two sureties each, as part of the conditions for their release on bail.Additionally, they were prohibited from leaving the country and ordered to regularly attend court proceedings. They were also directed to refrain from engaging in any further criminal activities.Voting for the Rajya Sabha elections took place last month at Vidhana Soudha. Following the declaration of the results, the three accused men were alleged to have shouted "Pakistan Zindabad" slogans while celebrating the victory of Indian National Congress (INC) candidate Naseer Hussain.A criminal case was then lodged against the three accused at the Vidhana Soudha Police Station over their alleged conduct. The three men later sought their release on bail.Counsel for accused persons argued before the trial court that the police had failed to give any notice to the accused under Section 41 of the Code of Criminal Procedure (CrPC) prior to their arrest. As a result, the alleged declaration sample was sent to the Forensic Science Laboratory for sound examination.Taking these facts into account, the judge granted bail, considering that same presented a prima facie case in favour of the accused persons.
